New Government ePayment Regulation Costs Small Business $10 ...

The small business economy is suffering considerable harm from new regulations being enforced by the IRS this year. There?s a new tax form that?s causing this trouble for small business owners who collect ePayments and conduct eCommerce. The IRS Form 1099-K requires merchant processors and third-party payment processors, such as PayPal and Square, to report the income that individuals and small businesses were paid through their services to the IRS in 2011. The IRS estimates that 53 million of these forms should have been sent for tax year 2011, making it the 10th highest volume tax form in it?s first year of existence.

That?s a lot of small businesses being hit by the implementation of Internal Revenue Code Section 6050W.

The intention of the reporting law was to close the tax gap ? the estimated $385 billion that the government loses from the under-reporting of income. The regulation created a reporting requirement for payment processors as a ?check and balance? system to provide transparency into electronic and credit card payment earnings for income tax purposes in the same way employers send out W-2?s to report employees? earnings.

Without taking this new law into account, $140 billion and 3.5 billion hours of time are spent on tax compliance each year. Outright?s calculations suggest that over $10 billion in additional costs (approximately $180-$200 per form received) are being incurred. Given that the IRS is only expecting to raise an additional $9.5 billion in extra revenues from this new law over the next 10 years, this implementation has created a net loss to society over the next decade.

And the impact on the solo entrepreneurs who are already working six days a week to find and serve customers is high, in contrast to the original intent. In the Federal Register discussion of the regulation, one paragraph states, ?The Treasury Department and the IRS certify that the regulations in this document will not have a significant economic impact on a substantial number of small entities.? ?But the millions of businesses that take electronic payments and have high transaction volumes are spending additional money and investing time to comply.

Getting transparency into the eEconomy makes sense. The Commerce Department estimates that $194 billion in sales were made online in 2011, 16 percent higher than 2010 and growing twice as fast as retail sales in general. But the IRS needs to clarify this reporting requirement for ePayments merchant account and payment processors to lighten the load on small businesses across America. The reporting requirement needs to be amended to provide a standard definition of what constitutes gross sales, so that ePayments providers can be consistent.

Additionally, the third-party payments providers should be required to report on expenses they know of, including total fees, returns, sales tax collected, and fraudulent transactions. This would be consistent with tax forms like the W2, which reports personal income plus deductions and taxes paid. Providing this additional information would make it much easier for the small business to have the information they need for taxes.

This solution would allow for transparency of income generated within the digital economy and reduce the burden of figuring out the correct numbers for taxes. Small business owners would then be able to focus more of their energy on growing their businesses and lifting the economy as a whole.

While the film has already racked up the third biggest opening weekend in history with $155 million dollars and continues to sell out theaters, its soundtrack has also taken to the top of Billboard?s charts.

Featuring songs from artists such as The Civil Wars, Taylor Swift, Maroon 5, Arcade Fire, and others, the album creates the somber, but at times hopeful mood that the film portrays: a headstrong girl thrown into the turmoil of a corrupt tournament controlled by the government in order to save her younger sister. Though none of the lyrical songs featured on the album are actually played during the duration of the film ? not even Taylor Swift and the Civil Wars popular song, ?Safe and Sound?, which most audience members thought would be played during one of the tribute?s dramatic death scenes ? the movie is still carried by Jennifer Lawrence?s impeccable acting and the perfectly tuned underscore composed by composer James Newton Howard.

?I really loved the [instrumental] music played throughout the film because it didn?t take away from what was going on in the film,? junior Safiya Isman said. ?I only wished that they had played more of the popular songs from the soundtrack during the movie.?

Though some were disappointed that the more admired, lyrical songs were only played during the credits of the movie, this hardly seems to matter as soundtrack sales skyrocket to 175,000 copies sold in just its first week, pushing One Direction?s Up All Night to No. 4 on the charts while Adele?s 21 still holds the spot for No. 2. With the number still growing, the album becomes the first theatrical soundtrack to top the Billboard?s charts since 2009?s Michael Jackson?s: This is It.

?I really love the album,? junior Patricia Webb said. ?It?s just something you can?t stop listening to and even when you do, the music still keeps playing in your head.?

An email that landed in our inbox today details what we can expect. First out of the gate is a whole bunch of bug fixes. Seems there are a variety of bugs affecting players, including crashes, problems completing turns and coins, colors and bombs not displaying -- and sometimes you really need one of those bombs. The good news though, these will all be fixed when the update lands.

But what about new features? Well, we're due a few of those as well. On the list are:

This isn't mentioned for our iOS friends though, so it looks like at that end we'll still be left waiting for them.

Under the share purchase agreement signed on Friday, Egco will acquire 4.5 million shares of G-Power Source Co Ltd (GPS), the developer of 4 solar power plants. While the shares cost Bt630 million, Egco is earmarked another 108 million for the construction cost.

According to Sahust Pratuknukul, president of Egco, GPS has struck the power purchase agreements with the Provincial Electricity Authority for the four power plants, which has the combined capacity of 26 megawatt. They require a total investment of Bt3.1 billion. GPS will enjoy special tariff of Bt8 per unit for the solar power, of which supply from three plants started in March.

Two of the three plants are located in Nakhon Sawan and one in Chai Nat. The fourth power plant is scheduled for operations in December 2012.

"The investment is in line with EGCO Group?s strategies to expand its business towards the renewable energy and also responds to the company's responsibility towards society and the environment as well as the government?s policy regarding renewable and green energy." Sahust said.

Earlier this week, Ratchaburi Electricity Generating Holding Plc also teamed up with SPCG Plc to develop 3 solar farms in Nakhon Ratchasima.

Egco Group currently has 28 operating and developing plants with total installed capacity of 5,029 MW which 110 MW is from 12 renewable power plants comprising of Roi-Et Green (Rice Husk), Yala Green (Parawood), Lopburi Solar, SPP 3 and SPP4 (Solar), Theppana Wind Farm and 6 solar power projects developed by Yanhee EGCO Holding Co Ltd.

Family Ties : The Last Word On Nothing

Not my family.

It?s been almost a year since I wrote about my genetic testing results from?23andMe. That?s because, despite paying $5 a month for the site?s mandatory Personal Genome Service?,?I rarely look at it.

It?s not that I?m scared of the data (been there), and not because I forgot ? every six or eight weeks I get an email from the company saying things like, You have 8 new results from 23andMe! New discoveries have been made about your DNA! I hadn?t visited the site because, frankly, I was bored of it. How many times is one expected to look sort-of-interesting, sort-of-meaningless risk calculations and ponder healthier ways to live?

Then at a conference last week, while trying to make small talk with a scientist, I mentioned my 23andMe subscription. Turns out he has one, too. ?Isn?t it funny when you get those messages from your distant relatives?? he said. I told him I didn?t know what he meant. ?I get them all the time,? he said, shaking his head.

Back at my desk Monday morning I found myself on my 23andMe page, staring at 20 new messages in my 23andMe inbox. All had the same subject line: ?A relative would like to make contact with you.? I clicked on one and saw a tiny square photo of the sender?s face, and this message (photos have been dropped, names changed and text truncated):

Enough, enough. I called my younger sister, who?s visiting me this week, over to the computer. ?Aren?t these people creepy?!? I said.

Genealogical titillation isn?t some new byproduct of the genomic revolution, of course. Our father was obsessed with tracing his roots. He began in earnest in the 1960s, making pedigree chart after chart, filling in holes after fact-finding trips from his home in Michigan to cemeteries and libraries in North Dakota and Minnesota and who knows where else. About 10 years ago, he moved his hunt online. He transferred his hand-written pedigrees onto the Family Tree Maker computer program. He scoured Amazon and AbeBooks for rare books, so old their spines disintegrate with each touch, full of names and deeds and other official records. He had long, back-and-forth email conversations with ?relatives? registered on sites like Ancestry.com.

After he died, my sister and I didn?t know what to do with the products of all this meticulous detective work. I have a yellowing piece of paper hanging on my office wall that certifies him (and therefore, me) as a member of the General Society of Mayflower Descendants. And my Gmail archives are full of his 500-word biographies and sloppily scanned photographs of this or that ancestor (like his favorite, Alexander Hughes, at left, who was an entrepreneur and legislator in the Dakota Territory). But the bulk of the work sits in cardboard boxes in a closet in Michigan.

Intrigued by my sister?s sympathetic reaction to our long (long) lost 23andMe relatives, I took a closer look at their head shots. We all look vaguely similar: pale, ruddy, sturdy. And I have no trouble believing that our great-grandparents? grandparents once broke bread together in pale, ruddy, sturdy communities in Norway and Ireland.

But that doesn?t answer the question that I used to ask my father, with a little too much exasperation, over and over again. What makes these ancestral connections so fascinating? And why would anybody want to share intimate family details with people who are, in every way that matters, complete strangers?

Smokey Robinson-backed Aussie pop group to tour US

DETROIT (AP) ? An Australian pop quartet's music really got a hold of Smokey Robinson.

Motown Records' signature vocalist loved Human Nature's take on the legendary label's standards so much that he signed on as the group's official presenter and helped facilitate a lengthy run for it at the Imperial Palace hotel in Las Vegas.

Now, the guys are heading out for their first U.S. tour, which kicks off Saturday in ? where else ? Detroit.

Human Nature (brothers Andrew and Mike Tierney and fellow high school classmates Phil Burton and Toby Allen) have released nine albums, five of which went to No. 1 in their native country.

They've opened for Celine Dion and Michael Jackson in Europe and Australia and performed the national anthem at the Summer Olympic Games in their home city of Sydney in 2000.

But it was their 2005 Motown tribute, "Reach Out," that attracted the attention of Robinson.

"They came to the studio one night in Los Angeles ... and sang for me a cappella with no music ? just them singing ? and blew me away, man. Just awesome," the Rock and Roll Hall of Famer told The Associated Press in a phone interview. "I am so enamored with them."

And, thanks in part to Robinson's backing, the group nailed down an exclusive booking at the Imperial Palace, where they have played five and six nights a week to sold-out crowds for the past two-and-a-half years.

The group is moving beyond Nevada with the 10-city tour, which will take them to Washington, New York, Chicago and Boston through May 6. Add to that a PBS special ? featuring Robinson ? that began airing in December and a CD of Motown covers that was released earlier this month, and Human Nature is well on its way to expanding its influence beyond its roots in Oceania.

Not only does the group have Robinson to thank for its stateside successes, but also the music of Motown, which enjoyed its heyday nearly a half-century ago but has been embraced by generations of listeners drawn to its timelessness.

So, what could these guys possibly bring to the music that hasn't been done better by Robinson, Marvin Gaye, Stevie Wonder and company?

"They have put their own touch on (the songs)," Robinson said. "They sing the Motown music, but they do it like Human Nature does it."

For their part, Human Nature simply loves singing the songs.

"Our roots lie in American soul," Andrew Tierney said. "It's the ultimate market for what we love."

It may seem strange on the surface that this particular group is helping to carry on the Motown legacy. But considering the label's reputation for busting through color barriers, it does make sense.

"Why should people listen to four white Australians sing these songs when they're ubiquitous on radio and TV?" Andrew Tierney said. "It just shows that this music is written for everybody and that it has reached to every corner of the globe, including Australia. And it's still influencing people, just as it touched us."

IRS forms "SWAT team" for tax dodger crackdown

WASHINGTON (Reuters) - The Internal Revenue Service is staffing up with high-powered talent to crack down on companies shifting profits from country to country to lower their tax bills, a strategy the agency has targeted before with only limited success.

The IRS showed its elevated concern on the issue, known as "transfer pricing," last May by hiring Samuel Maruca to fill the newly created post of transfer pricing director.

He has since brought aboard specialists from Big Four audit firms KPMG and Ernst & Young LLP , as well as law firm Mayer Brown and boutique consultancy Horst Frisch.

Maruca, who came from law firm Covington & Burling, is still recruiting. He told Reuters the agency previously had "had a difficult time attracting and retaining economists."

Now, he said, the IRS's international group "has significant external hiring authority."

Transfer pricing is a booming field of global tax law. It involves multinational corporations that are constantly moving goods, services and assets from one subsidiary to another in different countries and how they account for these "transfers."

By carefully manipulating the pricing of such moves, companies can effectively shift profits to low-tax countries from high-tax ones, lowering their overall tax costs.

Governments in the developing and developed world, many of them faced with crushing deficits, are working to curb transfer pricing because it reduces corporate tax revenues.

IRS Commissioner Doug Shulman made changes at the agency in mid-2010 that set the stage for bringing in Maruca, who has filled 40 positions so far and plans to bring on up to 60 more staffers.

The IRS, which employs 90,000 people, saw its budget cut by 2.5 percent by Congress for fiscal 2012 to $11.8 billion.

UNDERPAID AND OUT-GUNNED

Federal agencies often struggle to keep up with higher-paid private-sector professionals. The IRS is no exception and there is some skepticism about Maruca's chances.

"The economic crisis allowed the IRS to attract talented, experienced industry professionals who might not have been available previously," said ex-deputy IRS Commissioner Michael Dolan, now director of KPMG's Washington national tax practice.

"The $64,000 question is, what will be able to do ... and will he really have enough resources to change the game?"

To curtail tax avoidance through transfer pricing, governments seek to limit the ability of corporations to manipulate transfer prices. National laws, though variable from country to country, generally call for "arms-length" pricing.

In theory, that means corporations must set transfer prices that are at or near market level, not artificially raised or lowered. But enforcement is complex, especially for intangible assets, such as search-engine algorithms or trademarks.

"The valuation problems are insurmountable," said Edward Kleinbard, a professor at the University of Southern California and former chief of staff at the Joint Committee on Taxation, which analyzes tax policy for the Congress.

"There are billion-dollar disputes on just the arms-length transfer pricing of intangibles."

In December, payment transfer firm Western Union Co announced it was part of a $1.2 billion transfer pricing settlement with the IRS for taxes owed from 2003 through 2011. The dispute included intangible property and trademark royalties.

IRS LAGS

By one measure of transfer pricing enforcement, the IRS lags behind tax treaty partners. In fiscal 2011, 85 percent of transfer pricing audit adjustments were initiated by a foreign country, rather than by the IRS, according to IRS statistics. That was up from 77 percent in fiscal 2010.

Two major transfer pricing court decisions went against the IRS in 2009 and 2010.

"Clearly, the IRS is trying to figure out what to do next on its litigation strategy in these important transfer pricing cases," said Eric Solomon, a director at Ernst & Young, who called Maruca's group a "SWAT team."

As the IRS raises its game, the pharmaceutical and high-tech sectors can expect close scrutiny, tax professionals said.

Businesses are sure to fight back. The IRS has ruffled feathers on transfer pricing before with limited results.

"Anybody who thinks the IRS can ultimately enforce transfer pricing is either an eternal optimist or delusional," said Richard Harvey, a tax professor at Villanova University and former senior adviser to the IRS's Shulman.

The staff changes and hiring at IRS "will help them on the margins," Harvey said. "But they're still fighting a very difficult battle where the deck is stacked against them."

Faster-than-light neutrinos expose the inner workings of science

It looks like the faster-than-light neutrino saga ? or should that now be slower-than-light or the-same-speed-as-light? ? may nearly be over. On Friday, CERN updated their statement on the initial OPERA result with some new results from ICARUS, another experiment at the Gran Sasso laboratory in Italy.

Here are the important bits of the statement:

The ICARUS measurement, using last year?s short pulsed beam from CERN, indicates that the neutrinos do not exceed the speed of light on their journey between the two laboratories.

The ICARUS experiment has independent timing from OPERA and measured seven neutrinos in the beam from CERN last year. These all arrived in a time consistent with the speed of light.

The ICARUS experiment has also uploaded a paper to arXiv.org, if you want more detail on how they conducted the experiment. (Or if you like your sentences oddly worded, like this: ?The result is compatible with the simultaneous arrival of all events with equal speed, the one of light.?)

So, that?s that. Or is it?

In the updated statement, CERN Research Director Sergio Bertolucci stresses the importance of rigour in scientific experiments. Bertolucci says:

The Gran Sasso experiments, BOREXINO, ICARUS, LVD and OPERA will be making new measurements with pulsed beams from CERN in May to give us the final verdict. In addition, cross-checks are underway at Gran Sasso to compare the timings of cosmic ray particles between the two experiments, OPERA and LVD.

The more measurements we have, the more sure we can be of the result. But the evidence is starting to suggest that the initial OPERA result was wrong.

Bertolucci goes on to say:

Whatever the result, the OPERA experiment has behaved with perfect scientific integrity in opening their measurement to broad scrutiny, and inviting independent measurements. This is how science works.

A commenter on this blog has said that the whole faster-than-light neutrino saga (as I?m quite enjoying calling it) is a ?failure of communication rather than physics.? But I don?t think it is necessarily a failure of anything.

As many people have pointed out, OPERA behaved exactly as they should have done. There was no way they could have sat on the result until they had checked it further. It would have leaked eventually, and them keeping quiet wouldn?t have helped speculation or science. More, independent measurements are always good. Openness, in theory, is always good.

When they announced their result, they did so in the best possible way. In a statement the collaboration said:

Given the potential far-reaching consequences of such a result, independent measurements are needed before the effect can either be refuted or firmly established.

Once the result was announced, there was no way the media could have not reported on it. If it was true, it would have changed physics forever.The general tone of articles about the initial result suggested that most news outlets were sceptical of the result. In a good way. It was more ?Oh look, some physicists might have proved Einstein wrong, weird huh?? than ?OH MY GOD RUN FOR THE HILLS CAUSALITY IS NO MORE!?.

Ok, the whole ?dodgy wiring? update was too good not to poke a little fun at. But it was harmless. I don?t think anyone who commented on it sounding a little silly was suggesting that the scientists had been stupid to make that mistake. I certainly was not suggesting that.

In a way, to put the result down to an experimental error as mundane as dodgy wiring is rather comforting. It reminds us that science is done by scientists who are human too, and fallible just like everyone else. (Except their mistakes almost accidentally bring down Einstein?s theory of relativity, rather than resulting in a broken hairdryer.)

In fact I?m inclined to think that the faster-than-light neutrino saga has been rather good for the relationship between science and the rest of us. Or, at least, it has the potential to be good. Perhaps now we can stop pretending that science is this big impersonal entity that moves along in increments the exact size of a scientific paper. Perhaps we can realise that science and scientists can make mistakes, but that?s ok.

If the story of the faster-than-light neutrinos is a failure of anything, it?s the way we think about science. Sergio Bertolucci was right when he said ?this is how science works.? We just need to get used to it.

Everyone along Colorado?s veteran back line had blue ribbon days, including Drew Moor ? after his late sliding challenge nearly turned disastrous straight away, that is. Rapids right back Kosuke Kimura and left back Luis Zapata were solid, defending with authority on a day when their club?s defending in higher areas looked disheveled.
PPL Park is a bugger of a place to play. For everyone else, that is. The Rapids are 2-0-1 there.
The Rapids clearly are still adjusting to Oscar Pareja?s 4-3-3. They struggle to find their defensive shape quickly enough upon losing the ball, and it occasionally leaves Pareja?s men vulnerable.
Personally, I?d prefer to see Omar Cummings wide in the Rapids? new way. He?s just not a target man, although his speed can stretch defenses.
The game could have looked very different; Moor tripped speedy Danny Mwanga just outside the Colorado penalty area, just seconds into the match. Referee Mark Geiger could easily have judged Moor guilty of denying a clear goal scoring opportunity, which would have put the home team on a man-advantage for 89 minutes.
Geiger is a young referee, perhaps with a bright future. He even did the FIFA Under-20 World Cup final last summer. But he needs to call a few more obvious fouls. When those go uncalled, players get frustrated and matches begin spinning out of control.
There?s no excuse for Jeff Larentowicz?s mad moment, as he crashed dangerously into Union midfielder Keon Daniel to earn a second yellow. Veteran players must absolutely keep their emotions in check (especially when sitting on a caution).
Union boss Peter Nowak left his captain, Danny Califf, on the bench for this one.
While all the goalkeeper talk will circle Philly?s young Zac MacMath (he allowed another stinker), this should be noted: Rapids veteran Matt Pickens needed to be better on Philadelphia?s goal; if Pickens gets his hands behind the ball (rather than beneath), he makes that save.
Clearly, Nowak and the Union have some ?thinking? to do where their shaky young goalkeeper is concerned. More on that later ?
